4、Freedom of association 结社自由

4.1    Do the unionised workers get the same treatment than the non-union workers? If not, specify.加入工会的工人与没有加入工会的工人相比,待遇是否一樣,若不一樣,请说明

4.2    In case there is no trade unions or workers' associations formed at the factory, is there clear evidence that all information and possibilities have been offered by management to workers?如没有工会这样的组织的情况下,是否有充足的证据表明工厂管理层会向工人传达相关信息?

4.3    Is workers' right to form and join free trade unions and workers' associations acknowledged by workers?工人是否完全被告知有权力参加工会和组织自由结社?

5、Discrimination 歧視

5.1    Is non-discrimination guarantee in term ofemployment, promotion, compensation, welfare, dismissal and retirement, etc. within the company based on criteria of race, religion, national origins, sex, handicap, sexual orientation or political affiliation?
在受雇期間有無反歧視保証條約包含晉級,賠償,福利,遺散,退休..等 公司基於宗教,國籍, 性別, 殘障或是政治上同盟同样標準对待?
5.2    Is equal salary for equal work for male and female workers implemented at the factory?工廠男性和女性同工同酬嗎?
5.3    Is the factory free of sexual harrasment,especially on young female workers?在工廠免於性騷擾,特別是年輕女性工人?

5.4    Does the factory have a copy of valid laws and regulations on non discrimination or understand its requirement?工廠是否有有效的反的法律法规文件?
5.5    Does employment reflect local ethnic/religious breakdown - no domination by one group?員工如反映當地有種族/宗教歧視?沒有一團體有支配权?

5.6    Do workers representatives have access and familiarity with procedures for filing complaints about discrimination?員工代表是否有途径表达对歧視的不满并且了解其申诉程序?

6、Disciplinary practices 懲罰措施

6.1    Are mental / physical /sexual coercion forbidden and avoided in the factory? If no, precise.

6.2    Does the factory have documented disciplinary rules and communicated to all workers?工廠是否有懲戒規則的文件并告知所有工人?

6.3    Are the disciplinary rules fair, reasonable and legal or validated by local government authority?懲戒規則是否公平合理? 是否有法律或當地政府授權 ?

6.4    In case of wage deductions, are they fair,comprehensible and written into disciplinary rules?如有減薪, 是否公平並寫在懲戒規則里?

6.5    Does the factory have a copy of valid laws and regulations on disciplinary practices or understand its requirements?工厂有持有相关法律文件副本吗?或了解及懂得它的要求?

7、Working hours  工時

7.1    In case on non-compliance, does the working hours of individual workers respect 60 hours per week? Detail.每个工人每週工作时间是否不超过60小时?请详细说明
7.2    Do workers have at least a day off once a week?员工每周最少休息一天吗?

7.3    Is the working hours of individual workers recorded by time card, attendance record or other reliable recording system?有無每个员工的考勤记录或有其他可靠的記錄系統?

7.4    Do the working hours of individual workers comply with local regulation? (If there is no local legal standard, the minimum standard is set at maximum 60 hours per week, 12 hours per day). If no, precise what is the maximum of hours found, how often the non-conformity happens (in exceptionnal circumstances, regularly, always) and what is the pourcentage of employees who are working more than 60 hours (a few of them, some specific section, most of them, all of them).员工的工作时间是否符合当地法规?(如果当地没有规定,工人的工作时间应符合最低标准为不超过60小时/周,12小时/天),如不符合,请提供确切的时间,多长时间发生一次(偶然,经常,总是?)有多少比例的职员工作时间每周超过60小时(少数人,多数人,所有人)

7.6    Do workers have reasonable time for mealbreaks and rest break? 工厂是否有合理的进餐时间及休息时间?
7.7    Do workers work overtime voluntarily? Do they have the right to refuse overtime?工人加班是自愿的吗?工人有权利拒绝加班吗?

7.8    Does the factory have a copy of valid laws and regulations on working hours or understand its requirements?工厂有持有相关法律文件副本吗?或了解及懂得它的要求

7.9    Does the factory have written policy on working hours, rest and vacations and communicate to all workers?工厂有关于工作时间、休息及休假的书面政策,并传达给工人们吗?

8、Compensation 工資報酬

8.1    Do all workers’ wages meet local minimum wages (including trainees / apprentices / workers in probation period)?所有工人的工资是否符合法定最低工资要求(包括实习生,学徒,试用工)

8.2    Do all workers's wages meet local minimum wages including overtime paid on legal rate?所有工人工资是否符合法定的最低工资规定? 包含按法定的加班费率支付加班费?

8.3    Are all compensation always paid  in cash/cheque/direct to bank (and not in any other form such as food or in-house advantages)?全部补偿费用總是用现金/支票/直接银行来支付吗?(而非其它的例如餐费、宿舍补贴条件)

8.4    Is the payment frequency reasonable (maximum one month) and on a regular basis (no withhold workers' wages)?是否以合理的时间段(最长一个月)和定时(不拖欠工人工资)发放工资?

8.5    Is extra work always paid (even if production target demanded is not fulfiled or if non-conform product have been produced)?額外工作是否总有支付(既使生产目標需求未完成或有不符合品质的产品而產生的)?

8.6    Do workers receive correctly calculated wages per local legal requirements?工人是否收到按当地法规正确结算的工资?

8.7    Are deductions fair, reasonable and legal (such as social insurance or other tax)?是否扣除合理的和法规要求费用(社会保险及其它稅金)?

8.8    Are all workers provided social insurance per local legal requirements (including employee and employer fee)?是否所有员工按当地法规要求的缴纳社会保险(包括员工及雇主的费用)

8.9    Does the factory have a copy of valid laws and regulations on compensation and benefits or understand its requirements?工厂是否持有补偿和福利的有关法律文件,并了解它的要求

8.10    Does the factory have written policy on compensation and benefits and communicated to all workers?工厂是否有書面關於补偿和福利政策,并传达给所有员工

8.11    Does the compensation and benefits policy meet local laws and regulations on working hours?补偿和福利政策是否符合當地工時法規? 

8.12    Is compensation calculation method communicated to all workers and understood by them clearly?是否公开传达给员工关于补偿的计算方法。
