Estee Lauder验厂咨询-雅诗兰黛供应商准则之从劳动权益到商业道德的全方位要求

Legal Compliance:  The Estee Lauder Companies (Estee Lauder) is committed to conducting its business in accordance with the highest ethical standards and in compliance with all applicable laws and regulations in the countries where we do business.  We will meet or exceed requirements of applicable environmental, health and safety laws and regulations, corporate standards and other standards to which the company subscribes, and we expect our business partners to do the same.
关于法则:EL公司希望所从事的商业活动既符合商业道德标准,又必须遵守当地的法纪法规。同时我们也更注重合适的环境,健康,以及安全等方面的法规。另外还有各公司制订的一些标准,我希望我们的合作者也能同样遵守。

Child Labor:  Estee Lauder suppliers must not employ child labor. The term "child" means any person employed under the age of 15 (or 14 where the law of the country permits) or under the minimum age for employment in the country, whichever is greater.
 童工:EL供应商们一定不能雇佣童工,童工的定义是在15岁或以下(有的国家规定的是14岁)。

Forced Labor:  Estee Lauder suppliers must not use forced or compulsory labor of any kind, be it prison, bonded, indentured or otherwise.  Furthermore, mandatory overtime is not permitted, and workers must be allowed to leave their employment after giving reasonable notice.
强迫工作:EL公司供应商们不允许有任何强制性的劳动,象监狱一样对待的,以及以契约束缚的。此外,强制加班工作是不允许的,如果员工在给出合理的解释以后,是可以允许离职的。

Human Rights: Estee Lauder suppliers must treat their employees with respect and dignity.  They must not engage in any kind of physical, verbal, psychological or sexual abuse or misconduct.
人权:EL供应商必须尊敬劳动者,不能有任何形式的身体上的,言语上的,心理上的,以及性虐待,和处理不当。

Hours:  Estee Lauder suppliers must uphold the local legal limit on hours worked, and where no limit is imposed, they must not engage workers for more than 60 hours a week at most, outside of extraordinary circumstances.  Workers must receive at least 1 day off each week and must not be required to take work home.
工作时间:EL供应商必须遵守当地的法规作息时间,没有强迫的限制加班,员工必须在很好的加班环境中,最多一个周的工作时间不能超过60小时,员工必须一个周至少有一天的休息时间,而且不能要求员工把工作带回家中做。

Wages:  Estee Lauder suppliers must pay their employees either the legal minimum wage or the prevailing industry wage, whichever is higher, as well as any legally prescribed benefits.  Workers must not be subject to financial penalties for poor performance or face illegal deductions for benefits payments.
薪资待遇:EL供应商必须支付最低工资和现行的行业的工资,后者待遇可能会好点,必须享有法定的福利待遇,对于表现不佳的员工不能有金钱上的处罚,或者非法扣除员工应得的收益。

Discrimination:  Estee Lauder suppliers must not subject their workers to any unfair or unjustified discrimination with regard to hiring, remuneration, promotion or termination.  Any employment decisions must be based on worker ability and not on personal characteristics such as gender, race, religion or culture.
歧视:EL供应商在对于员工的雇佣,报酬,提升,以及解雇方面,不能有任何的歧视和不公平,任何一个关于员工的决策,都应该根据员工的能力范围来决定,而不是带有任何的有色观点,如:性别,种族,宗教信仰和习俗。

Freedom of Association:  Suppliers must recognize the right of employees to freely associate and must comply with all local laws governing the right of employees to select or not to select workplace representatives.
结社自由:EL供应商必须认同员工的自己结社的权利,必须遵守当地的法律控制和调节员工选举自己代表的权利。

Health and Safety:  Estee Lauder suppliers must ensure that their workers perform their work in clean, healthy and safe environments.  Any residential facilities must be similarly maintained.  Work areas must be of a standard to prevent accidents and illnesses and to ensure an adequate level of sanitation.
健康与安全:EL供应商必须保证所有员工的工作环境,必须在一个干净,安全,健康的环境中作业,必须保养好住宿设施,工作区域必须有怎样防止事故和疾病发生的标准,确保环境卫生达到一定的水平。

Environment:  In addition to upholding local environmental laws, Estee Lauder suppliers must strive to continually improve their performance.
环境:为了有利于支持当地环境法的实施, EL供应商必须不但的改正和完善工作环境。

Subcontracting:  Subcontractors must agree to abide by Estee Lauder’s Code of Conduct.  All manufacturing facilities, including decorating facilities, may not be changed without notice to and approval by Estee Lauder. 
承包商:承包商必须遵守EL的行为守则,所有的生产设施,包括装修设施,不得在未通知EL并同意的前提下随意更改。

Communication:  Estee Lauder suppliers must make all reasonable efforts to communicate the Estee Lauder code of conduct to workers and must ensure that workers have the opportunity to ask questions and make complaints under the code.
沟通交流:EL供应商必须将EL的行为准则,合理的解释给员工,而且必须确保员工有机会允许提问,在遵守准则的前提下抱怨。

Ethical Practices:  All Estee Lauder suppliers must adhere to the highest standard of business ethics.
道德操守:EL供应商必须严格遵守商业道德。

Estee Lauder Companies will work with suppliers to roll out the Supplier Code of Conduct training and audit from January 2009.  All critical suppliers will receive a separate letter with a detailed schedule for your manufacturing plants. Attached is a quick reference sheet that may answer some of your questions on the audit. 
从2009年一月起EL公司将与能遵守守则的供应商合作,所有关键的供应商将收到一份单独的信,上面会有详细的日程表。附件是一些关于审计问题的参考。

 In cases of supplier non-compliance with the Code of Conduct, suppliers will be given 3~6 months to implement corrective actions, followed by a re-audit.  If the re-audit result is still a failure, supplier will be put on probation, and this may potentially lead to the termination of business with Estee Lauder. 
如果供应商不能遵守EL的行为准则,EL将给予3-6个月的改善期,之后会第2次审计,如果第2次仍然不合格的话,将视供应商为试用,这就意味着EL与这家供应商的合作已经终止。

Effective from January 2009, Estee Lauder Companies will only approve new suppliers or new manufacturing plants that pass Supplier Code of Conduct audit and QA audit. 
从2009年一月开始,EL公司将只会与通过行为守则和QA审计的供应商或工厂合作。
